CONSERVATION COMMISSION

MEETING DATE: July 10, 2006

The meeting convened at 6:05p.m.
6:05 – 6:55pm Roche – Beartown Mtn Rd, NOI Sediment Removal
Shannon Boomsma from White Engineering, representative for Mr. Roche presented the plans for sediment removal at Beartown Mtn Rd, east of Hupi Rd. There is a series of ponds and bridges along the property that they plan to remove sediment from. Pictures and site plan were provided. The board continued the project after a motion was made and seconded to close the public hearing until a completed “Simplified Wildlife Habitat Evaluation” is provided.
6:55 – 7:03pm - Alpert – Mt Hunger Rd – OOC Violation
Stephen D’Alessio and Shannon Boomsma inquired about the letter for the Alpert property on Mt. Hunger Rd. The board commented that it’s still a draft copy and will be discussed and hopefully finalized tonight.
7:05 – 7:15pm - Putrino – 17 Limerock Lane – RDA Add a walkway/deck on south side of house
Mr. & Mrs. Putrino explained their plans to add a walkway/deck on the south side of their house due to his wife’s handicap to eliminate all the “up and down”. They’d like to start the project ASAP and are using their nephew as the contractor. No machinery will be used, all the digging will be done by hand. A motion was made and seconded to approve the project as proposed (N3) with the following conditions: A silt fence has to be installed per the drawing prior to construction and all disturbed areas should be seeded and mulched to allow the grass to regrow.
7:16 – 8:00pm – Fainer – Main Rd – SMANOI – SMA06-11 – clear a driveway site, install driveway and drains and landscape disturbed area
Mr. Fainer presented his plans for the proposed driveway. He had the tree warden on the property several times and told him their intentions and he said ok. Approval for a driveway permit was received by Maynard Forbes, Director of Operations. He’s been cutting trees down there for several years and this was the first he’d heard of the Scenic Mountain Act. The trees that have already been cut and that are lying down there need to be physically removed. The remaining trees to be cut won’t be determined until a site for the house is decided at a later date when he will re-file. A paved apron will be put down and at about 3-5% grade, gravel will be placed down. Scott MacKenzie is the contractor. A motion was made to close the public hearing and approved.
The board approved the project as submitted with the following conditions:
1. The project is to construct a driveway of the length (approx 400ft) shown on the plans by SoilTech dated Sept 1988 titled “for Chang properties”
2. Proposed 3-6 trees need to be flagged, viewed by the Conservation Committee and approved as marked before driveway construction can begin
3. All disturbed areas are to be seeded and mulched
4. A properly installed silt fence shall be installed as shown on the drawings
5. Applicant shall call Tim Lovett at 528-0644 when the trees have been marked prior to commencing construction
For Discussion:
1. Meridith Oislander came in to discuss the pond on her property and the June letter she wrote to the board. Chris presented pictures from DEP over the last 10 years that show that indeed the pond was not there at one point. A site visit was done by the board members to verify that this pond was placed 95% on Ms. Oislander’s property and 5% on the person who created it. This person cleared and mowed wetlands and created a pond in the wetlands without permission. If the Commission can determine that wetlands were altered the board can require that the property be returned to it’s original condition. The board decided to
issue a letter to both property owners and Roger Tryon, the contractor.
2. Mail was reviewed.
3. The letter to Alpert/D’Alessio was reviewed and revised and will be typed up and sent out tomorrow.
4. Lombardo hearing was opened to discuss the letter from Berkshire Engineering regarding additional compensatory storage calculations. There were no representatives present and it was continued until more information is provided.
